1. Introduction
Welcome to QuadVenture Canada. These terms and conditions outline the rules and regulations for the use of our services. By accessing our website or using our services, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of them, you must not use our services.
2. Rental Agreement
When you rent an ATV from QuadVenture Canada, you enter into a rental agreement that is subject to the following terms:
- You must be at least 16 years of age to operate an ATV. Riders under 18 must have written consent from a parent or legal guardian.
- You must adhere to all safety instructions provided by our staff.
- You must wear all required safety equipment at all times during the rental period.
- You must stay on designated trails and obey all posted signs and instructions.
- You must not operate the ATV under the influence of alcohol or drugs.
3. Reservation and Cancellation Policy
We understand that plans can change. Our reservation and cancellation policy is as follows:
- A 50% deposit is required to secure your reservation.
- Cancellations made more than 48 hours before the scheduled rental time will receive a full refund.
- Cancellations made between 24-48 hours before the scheduled rental time will receive a 50% refund.
- Cancellations made less than 24 hours before the scheduled rental time will not receive a refund.
- In the event of severe weather conditions that make operation unsafe, we will reschedule your rental or provide a full refund at our discretion.
4. Liability and Waiver
ATV riding involves inherent risks. By using our services, you acknowledge and agree to the following:
- You will be required to sign a liability waiver before using our equipment.
- You assume all risks associated with the activity, including but not limited to physical injury, property damage, or death.
- QuadVenture Canada is not liable for any injuries or damages that occur during your rental period, except in cases of gross negligence on our part.
- You are responsible for any damage to the equipment caused by negligence, reckless behavior, or violation of our rules.
5. Equipment Care and Damage
You are responsible for the equipment during your rental period:
- A security deposit may be required and will be refunded upon return of undamaged equipment.
- You will be charged for repairs or replacement of equipment damaged during your rental period.
- Equipment must be returned in the same condition it was rented, except for normal wear and tear.
6. Use of Images and Video
We may take photographs or videos during your rental experience:
- By using our services, you grant us permission to use photographs or videos that include your image for promotional purposes.
- If you do not wish to be photographed or recorded, please notify our staff before beginning your adventure.
7. Environmental Responsibility
We are committed to environmental conservation:
- You must not litter or leave waste on trails.
- You must respect wildlife and natural vegetation.
- You must stay on designated trails to minimize environmental impact.
8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of British Columbia.
9. Changes to Terms
We reserve the right to modify these terms and conditions at any time. We will notify customers of significant changes by posting the new terms on our website.
